Payne & Fears Secures Summary Judgment for Fortune 10 Company Against Harassment and Retaliation Claims
Payne & Fears won a complete summary judgment for a Fortune 10 company in a case asserting claims for sexual harassment, failure to prevent harassment, FEHA retaliation, Labor Code Section 1102.5 retaliation, and public policy wrongful termination. We convinced a U.S. District Court to summarily adjudicate all causes of action in favor of our client and against Plaintiff in a case aggressively pursued by Plaintiff’s counsel. Plaintiff claimed sexual harassment and retaliation for reporting it multiple times. We convinced the court that the harassment was not actionable, and that Plaintiff was terminated for reasons other than the multiple complaints lodged.
