Kelby Van Patten is a partner in the firm’s Insurance Law Group.
He represents policyholders in a broad variety of insurance coverage disputes in federal and state courts across the country, and he has obtained significant published appellate decisions favorable to policyholders.
Kelby also counsels policyholders on insurance coverage issues and assists policyholders in negotiating with their insurers. Kelby has handled over 60 lawsuits over the right to independent counsel, and he has handled over 40 lawsuits over Buss reimbursement claims.
Representative Matters
- Recovered more than $13 million from a group of direct and additional-insured carriers for a major homebuilder in reimbursement of costs incurred to defend and settle a high-exposure construction defect lawsuit.
- Convinced an insurer that a significant trucking accident involved multiple occurrences and therefore provided multiple “per occurrence” limits, which created millions of dollars of additional indemnity coverage.
